The Day Nobody Marked

The stablecoin law could have started early if a bank regulator had finished its rules in time. None did, so on January 18, 2027 the law switches on by the calendar while its own rulebook is still out for comment.

About this episode

Section 20 of the GENIUS Act says the federal stablecoin law takes effect on "the earlier of" two dates. One is eighteen months after enactment, which is January 18, 2027. The other is 120 days after the primary federal payment stablecoin regulators issue final rules. That second path let regulators bring the law in early. By Astraea's count, the last day it could have worked was around September 20, 2026. The day passed with no final rule, no notice and no press release. Nine days later the Federal Reserve published its proposal, which can no longer move the date.

Maren and Abe go back to how the clock was built. They cover a one-year rulemaking deadline with no penalty attached, a definition that leaves out the two agencies Astraea judged furthest along, and a count of proposals that depends on who is counting and when. Then they look at what it means to plan around a law that takes effect before its rules are final: for trust-charter applicants, for New York's proposed Part 202, and for anyone filing comments right now. The episode closes with the next effective date to watch.

  1. The GENIUS Act became Public Law 119-27 on July 18, 2025.

  2. As quoted by Astraea, Section 20 says the Act ‘shall take effect on the earlier of, (1) the date that is 18 months after the date of enactment of this Act; or (2) the date that is 120 days after the date on which the primary Federal payment stablecoin regulators issue any final regulations implementing this Act.’

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  3. Eighteen months after July 18, 2025 is January 18, 2027, the statutory backstop effective date.

  4. Astraea calculated that primary-regulator final rules would have had to issue by roughly September 20, 2026 for the 120-day trigger to beat the January 18, 2027 backstop.

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  5. Astraea says the Section 13(a) deadline for implementing rules was July 18, 2026, one year after enactment, and that the Act attaches no penalty for missing it.

  1. Astraea’s analysis of Federal Register records, as of July 17 to 18, 2026, counted 11 proposed GENIUS Act rulemakings from the OCC, FDIC, NCUA, Treasury and FinCEN, and zero final rules.

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  2. Astraea says the Act’s ‘primary Federal payment stablecoin regulator’ definition names the OCC, Federal Reserve, FDIC and NCUA, not Treasury or FinCEN, so only those four agencies’ final rules can start the 120-day clock.

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  3. Astraea judged Treasury’s and FinCEN’s GENIUS Act rulemakings to be the most advanced as of July 2026.

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  4. As of July 17, 2026, Astraea wrote that the Federal Reserve ‘has yet to propose any standalone GENIUS Act rule.’

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  5. Astraea called January 18, 2027 the ‘prudent planning date’ for the Act’s effective date.

Kept on a lower-weight source (astraea.law); nothing we found says otherwise.

  6. The Anvesan tracker reported: ‘No final federal GENIUS Act rule had appeared in the Federal Register by 27 Sep 2026.’

Kept on a lower-weight source (anvesan.org); nothing we found says otherwise.

  7. Anvesan counted 13 proposed rules and one advance notice released by the agencies and Treasury between September 19, 2025 and September 24, 2026, with no final rules.

Kept on a lower-weight source (anvesan.org); nothing we found says otherwise.

  8. Anvesan reports that Treasury expects the GENIUS Act to take effect on January 18, 2027.

Kept on a lower-weight source (anvesan.org); nothing we found says otherwise.

  9. Treasury’s GENIUS Act proposal on payment stablecoin issuance, offer and sale was published in the Federal Register on August 18, 2026 as document 2026-16796, and Anvesan reports that its comment period closed October 19, 2026.

  10. The Fed’s proposal page lists the proposal as R-1899 with comments due November 30, 2026. It covers Board-supervised permitted payment stablecoin issuers and the tying prohibition in section 4(a)(8) of the Act.

  11. The FDIC Board approved its GENIUS Act proposal for FDIC-supervised issuers on April 7, 2026, with a 60-day comment period after Federal Register publication, and the proposal includes redemption generally within two business days.

Kept on a lower-weight source (angelinvestorsnetwork.com); nothing we found says otherwise.

  12. The OCC’s GENIUS Act proposal is Docket OCC-2025-0372, RIN 1557-AF41.

  13. NYDFS announced proposed 23 NYCRR Part 202 on June 9, 2026. The rule ‘would take effect once the GENIUS Act becomes effective,’ and existing issuers would have 12 months to comply, except for the certification requirement.

  14. Under the NYDFS proposal, the BSA/AML certification is due within 180 days of approval, or of the effective date for existing issuers, and annually after that.

  15. In December 2025, the OCC conditionally approved national trust bank charter applications for Circle, Ripple and Paxos, among others.

Reworded to match its sources. Original omitted that the approvals were conditional and dated December 2025. Circle, Ripple and Paxos are named in the evidence; one source conflicts on Circle's status.

  16. The fintechlaw.ai blog characterizes January 18, 2027 as a ‘Fixed Effective Date’ after the OCC missed the rulemaking deadline.

Kept on a lower-weight source (fintechlaw.ai); nothing we found says otherwise.

  17. The Federal Reserve Board proposed an AML/CFT program rule for banks on July 7, 2026.

Reworded to match its sources. Date was wrong. The Fed's own release says the Board acted on Tuesday, July 7, 2026. July 9 appears only in some secondary sources.

Removed during checking (2)
  • The Federal Reserve's proposal 'Implementing the Federal Reserve Board's Responsibilities Under the GENIUS Act' appeared in the Federal Register on Tuesday, September 29, 2026 (Vol. 91, No. 187, p. 61580, doc 2026-19860).

Why it was removed: US Government Publishing Office states something different: "M(D:20260929024039Z)".

  • Michael Powers, writing in an individual capacity, dated his comment on OCC-2025-0372 April 30, 2026. It identifies 'three supervisory gaps' in card-linked stablecoin programs and does not address the effective date.

Why it was removed: Couldn't be checked: a key record would not open.
